At Liberty Wellness Clinic, we are committed to protecting the privacy and confidentiality of our patients’ Personal Health Information (PHI). This policy describes how we collect, use, and safeguard your information in compliance with the Personal Health Information Protection Act, 2004 (PHIPA), and the standards of the College of Naturopaths of Ontario (CONO) and the College of Traditional Chinese Medicine Practitioners and Acupuncturists of Ontario (CTCMPAO).

1. Our Commitment to Privacy

We act as the “Health Information Custodian” for your records. We collect only the information necessary for your care and ensure it is stored securely.

2. Collection of Personal Health Information

We collect PHI directly from you or from person(s) acting on your behalf. This includes:

  •  Identification: Name, date of birth, and contact information.
  •  Health History: Physical/mental health history, family history, and TCM-specific diagnostic information.
  •  Clinical Records: Treatment plans, acupuncture point selections, supplement prescriptions, and progress notes.
  •  Financials: Payment history and insurance information for billing purposes.

3. Purpose of Collection (Your “Circle of Care”)

We use and disclose your information for the following purposes:

  •  To provide Naturopathic and Acupuncture assessment and treatment.
  •  To communicate with other members of your “Circle of Care” (e.g., your family doctor) unless you instruct us otherwise.
  •  To process third-party insurance claims or billings.
  •  To comply with regulatory requirements from CONO or CTCMPAO (e.g., peer reviews or audits).

4. Your Rights as a Patient

Under PHIPA, you have the following rights regarding your records at our Markham clinic:

  •  Right of Access: You may request to see or receive a copy of your health record.
  •  Right of Correction: You may request a correction to your record if you believe it is inaccurate or incomplete.
  •  Right to Withdraw Consent: You may withdraw your consent for the use or disclosure of your PHI at any time (subject to legal or contractual restrictions).

5. Safeguards and Security

We employ high-level security measures to protect your data, including:

  •  Electronic Security: Use of PHIPA-compliant software (Jane App) with 256-bit encryption and two-factor authentication.
  •  Physical Security: Secure, alarmed premises and locked filing systems for any paper records.
  •  Administrative Security: All staff and agents are trained on privacy protocols and are bound by confidentiality agreements.

6. Website and Digital Tracking

Our website uses cookies and tracking technologies to improve user experience and analyze our clinic’s marketing performance.

  • Google Analytics & Google Tag Manager: We use these tools to understand how visitors interact with our site. This includes tracking anonymized data such as your IP address, browser type, and the pages you visit. We use this information to improve our services and local search visibility in Markham.
  • Meta Pixel: We use the Meta Pixel to measure the effectiveness of our social media advertising. This allows us to understand actions taken on our site to ensure our marketing remains relevant to our community.
  • Data Control: These tools do not have access to your clinical health records or Jane App patient data. You can opt out of Google Analytics by using the Google Analytics Opt-out Browser Add-on or by adjusting your individual browser’s privacy settings.

7. Reporting a Breach

In the unlikely event of a privacy breach (loss, theft, or unauthorized access of PHI), we are required by law to notify you at the first reasonable opportunity and, if necessary, report the incident to the Information and Privacy Commissioner of Ontario (IPC).
